WILSON — A Beattie Avenue charged with driving while intoxicated on Nelson Road, had a .21 percent blood alcohol content, according to the Niagara County Sheriff's Office.
Patrol was dispatched to the 4900 block of Nelson Road around 6 p.m. Friday for a report of a vehicle in a ditch. When they got there, they found a vehicle in the woods approximately 50 feet off the road. In the driver's seat, was 44-year-old Brian Stover, 5857 Beattie Ave., who told patrol he had swerved to avoid a deer and had already called for a tow truck.
Patrol determined Stover to be intoxicated and placed him into custody at approximately 6:35 p.m. He agreed to a breath test at NCSO to which he subsequently submitted a sample of .21 percent, leading to the charges of driving while intoxicated, aggravated driving while intoxicated with a blood content .18 or higher, speed unreasonable and prudent,and driving on the shoulder.
He was taken to the Niagara County jail with a $250 bail set. The vehicle he was operating was towed by Jim's towing with a 12-hour hold. He is set to appear in the Town of Wilson Court on Tuesday.
