Jeffrey R. Hubert, 37, 3707 Hartland Road, Gasport, was charged with
Hubert's vehicle had crossed over the center line while driving north bound on Day Road. It then struck the guard rail on the west side of the road then a fire hydrant, finally coming to a stop in the front yard of 3976 Day Road.
While patrol was interviewing Hubert, he showed signs of intoxication and admitted to drinking beer and wine. After he failed field sobriety tests, he was found to have a blood alcohol content of .20 percent.
He was charged with driving on the shoulder, driving while intoxicated, and aggravated driving while intoxicated. He was then remanded to the NCSO jail where pre arraignment bail was set at $250. He is due in the Town of Newfane Court on Tuesday.
