Mary Ball
A 39-year-old Lockport-Olcott Road woman's failure to wear a seat belt on Friday resulted in a DWI, among several other traffic infractions.

According to the report filed by the Niagara County Sheriff's Office, Mary Ball, 3902 Lockport-Olcott Road, was seen traveling on Wheeler Road with no seat belt. As she pulled into Tops on Lockport-Olcott Road, patrol initiated a traffic stop for the seatbelt infraction.

During the interview, Ball told patrol that she currently possesses a hardship driver's license due to a previous driving while intoxicated arrest. Patrol asked why she was driving to Tops, to which she replied "to return a movie to the Redbox," according to the report. She then acknowledged that driving to Tops to return a movie is not a stipulation on her hardship driving privilege.

Ball told patrol that she had consumed one High Gravity alcohol beverage prior to operating her motor vehicle. Patrol then requested her to exit her vehicle and perform field sobriety tests, of which she failed four of five. A chemical test determined Ball's blood alcohol content to be .13 percent.

Her vehicle was towed and she was taken to Niagara County Jail where she was held on $750 bail. She was charged with felony DWI, aggravated unlicensed operation, operating a motor vehicle by an unlicensed driver and failure to wear a safety belt. She is to appear to the Town of Newfane Court to be arraigned on the listed charges this evening.
