CLARENCE — New York State Police charged a Lockport Man with DWI on Wednesday.
According to NYSP, Troopers responded to a report of vehicle stopped on the shoulder of Harris Hill Road in the Town of Clarence with the operator appearing to be asleep at the wheel. Upon arriving on scene, the Trooper interviewed the operator, who was identified as John D. Bender, age 47, from Lockport and determined him to be intoxicated.
Bender was transported to the SP Clarence station for processing where he refused to submit to a breath test. He was additionally charged with refusing to submit to a Breath test and was later released to a third party.
Bender is scheduled to appear in the Town of Clarence Court, on June 18.
