NEWSTEAD — A 65-year-old Royalton man was charged with DWI Saturday after Troopers responded to a call from a concerned citizen reporting a one-car collision.
Upon arriving to the scene on Cummings Road, Troopers found a vehicle with its rear passenger side wheel completely off, stopped in the northbound lane. The operator, identified as Thomas H. Baehr, stated that he lost control of the vehicle due to the road conditions and speed. The vehicle slid into a ditch causing the damage and came to rest on the roadway.
While investigating the collision, Troopers noted a strong smell of alcohol coming from Baehr, according to his arrest report. He was determined to be intoxicated and charged with DWI. He was then taken to SP Clarence for processing where he recorded a BAC level of .16 percent, twice the legal limit.
A check of Baehr’s license revealed that he had previously been convicted of DWI within a 10-year period. In addition to felony DWI, Baehr was charged with going at a speed to fast for conditions. He is scheduled to appear in the Town of Newstead Court on Jan. 21.
