NEWFANE — Niagara County Sheriff's deputies charged a Burt man with unlawful possession of marijuana following a traffic stop on North Main Street.
According to the report, Francis X. Dinino Jr., 39, had been seen passing through a red light around 6:37 p.m. Friday, causing NCSO to stop his vehicle. While interviewing Dinino, patrol could smell a strong order of marijuana. Patrol requested for him to exit the vehicle and he complied. While speaking to him outside of the vehicle regarding the smell, he removed a clear plastic bag containing marijuana from his pants pocket.
Dinino admitted that the substance is indeed marijuana and said there was another small bag of pot in the back seat of the vehicle. Patrol secured both bags of marijuana. Dinino was issued an appearance ticket for Unlawful Possession of Marihuana and a traffic ticket for the red light infraction. He was ordered to return to the Town of Newfane Court on Nov. 18.
Patrol secured the marijuana into an evidence locker in order for it to be sent to the laboratory for confirmation.
