CAMBRIA — A 49-year-old Newfane woman was charged with DWI and drinking alcohol on a public roadway late Saturday night.
According to a report filed by the Niagara County Sheriff's Office, Nancy A. Smith, 2791 Main St., Newfane, was seen by patrol crossing over the white fog line on the right side of the road several times shortly before 11 p.m.
Upon interviewing Smith, patrol could smell a strong odor of an alcoholic beverage coming from the vehicle and noticed smith had glassy eyes, slurred speech and impaired motor function. Patrol also noticed an open Molson beer can in the center console of her vehicle.
Smith was placed in custody for common law diving while intoxicated, but refused a breath test and any other form of test as well. Her vehicle was towed with a 12-hour hold, and she was remanded to Niagara County Jail on $500 bail. She is due in the Town of Cambria Court on Wednesday to answer charges of DWI, moving from the lane unsafely, refusing a breath test, and drinking alcohol in a motor vehicle.
