NEWFANE — A complaint of an erratic driver lead to unlawful possession of drug charges for a Corwin Station man Saturday evening.
According to the report filed by the Niagara County Sheriff's Office, David R. Upton III, 31, 6264 Corwin Station, was stopped on Bixler Road around 5:40 p.m. after someone had reported a reckless driver matching Upton's vehicle.
Patrol said that Upton did not appear to be intoxicated but was acting nervous. Upton was found to have a suspended driver's license and asked to exit the vehicle. Patrol then found a a green pill identified as Roxicodone when searching the vehicle. Upton also told patrol he had half of a Suboxone strip in his wallet, but didn't have prescriptions for either drug.
Upton's vehicle was towed and Upton was taken to the Niagara County Jail and held on $500 bail. He is to appear in Town of Newfane Court on Tuesday.
