NEWFANE — A Wrights Corners man was charged with DWI after Niagara County Sheriff's deputies say he was driving on the shoulder of Lockport-Olcott Road around 9:08 p.m. Wednesday.
Thirty-one-year-old Philip W. Barger, Jr., 7032 Wheeler Road, told patrol that he didn't have a driver's license because it was revoked in 2008 from a DWI conviction.
He also said the reason he was driving on the shoulder of the roadway was that he was eating his chicken fingers from a local bar.
Barger refused take a chemical breath test. He was charged with felony driving while intoxicated, felony aggravated unlicensed operation of motor vehicle, misdemeanor DWI and driving on the shoulder of the roadway. He was held in the Niagara County Jail in lieu of $750 bail and is to appear in the Town of Newfane Court on Tuesday.
