Brian Melcher
A 27-year-old Lockport man was charged with possession of marijuana after a traffic stop in Newfane Wednesday night.

According to a report filed by the Niagara County Sheriff's Office, Brian A. Melcher, 105 Van Buren Street, was seen swerving while driving northbound on North Main Street in Newfane around 9:30 p.m. on Wednesday. He was pulled over on Ide Road.

Patrol determined that Melcher was not under the influence of drugs or alcohol, but found that his license had been suspended less than a week prior for not answering a summons in the Town of Lewiston. He was asked to exit the vehicle and placed into custody on a charge of third-degree aggravated unlicensed operation.

Patrol asked him if there is anything illegal on his person or inside of the vehicle, who which Melcher stated that there is a small amount of marijuana inside the middle console in the vehicle. Patrol located the suspected marijuana and placed it into an evidence bag.

Melcher was taken to Niagara County Jail, where he was held in lieu of $250 bail. He is to appear in the Town of Newfane Court on April 29 to be arraigned on the charges of unlawful possession of marihuana, aggravated unlicensed operation and failure to stay right. The suspect marijuana will sent to the Niagara County Forensic Laboratory for confirmation.
