NEWFANE — A 40-year-old Getzville man was charged with DWI Tuesday afternoon after appearing intoxicated at Town of Newfane Court.
According to the Niagara County Sheriff's Office report, they received a tip that Nicholas A. Lichtenthal had arrived to court drunk, having driven a black Pontiac four-door sedan. NCSO had recently charged Lichtenthal with driving while intoxicated in the Town of Newfane.
Lichtenthal left court traveling westbound on McKee Road, according to the report. At approximately 4 p.m., Lichtenthal was found driving eastbound on Lake Road. He told patrol that he consumed two 16-ounce beers while working in Olcott and was driving home to Amherst.
Licthenthal was taken to Olcott Fire Company to perform standard field sobriety tests. He passed five out of six of them but was determined to be intoxicated, charged with DWI and taken to Niagara County Jail where he was held on $250 bail. While at the Niagara County Sheriff's Office, Lichtenthal's blood alcohol content was found to be .17 percent.
While doing an inventory search of the vehicle, patrol found an open 16-ounce beer can, along with numerous empties. As such, he was also charged with "drinking alcohol in a motor vehicle," in addition to the DWI.
He is scheduled to be arraigned on the listed charges in the Town of Newfane Court on Oct. 6.
