TOWN OF LOCKPORT — A 42-year-old Pendleton man is facing weapons, trespassing and theft charges after being stopped by police on CSX train tracks.
David P. Boettcher was charged Wednesday with third-degree criminal possession of a weapon: defaced for concealment, trespassing, and fifth-degree criminal possession of stolen property.
According to New York State Police, Troopers were dispatched to a suspicious vehicle parked on the side of Old Saunders Settlement Road. When they arrived, they found Boettcher walking near railroad tracks from where his vehicle was parked partially in the roadway. A CSX Special Agent came to the scene and requested charges be filed for trespassing.
During the course of the investigation, Troopers determined that Boettcher was taking railroad spikes around the railroad tracks and possessed a weapon with a defaced serial number which was located in his vehicle during an inventory before towing the vehicle from the scene.
Boettcher was arraigned in the Town of Lockport Court and remanded to the Niagara County Jail on $5,000 bail. He is to return to court on Thursday.
