WHEATFIELD — A Tonawanda Creek Road man who told Niagara County Sheriff's deputies he was on his way home from a Christmas party was charged with DWI on Tuesday.
According to the NCSO arrest report, Thomas P. Tomaino, 46, 6545 Tonawanda Creek Road North, was seen swerving and crossing the double yellow lines when he was driving on Shawnee Road at approximately 8:15 Tuesday.
When patrol stopped him, he said he was on his way home from a Christmas party in Niagara Falls. After interviewing him and performing field sobriety tests, deputies determined him to be intoxicated and charged him with DWI, driving on the shoulder, failure to use the designated lane, and refusal to take a breath test.
Thomas was slated for Town of Wheatfield Court on Wednesday.
