GASPORT — A 20-year-old Main Street man was charged with possession of marijuana after Niagara County Sheriff's deputies say he was speeding in a school zone.

According to the incident report, Kyle J. Foeller, 4533 Main St., was seen driving a silver Toyota, operating west bound at 66 mph in a posted 45 mph school zone around 7:30 a.m. Monday.

When Foeller was being interviewed by patrol, patrol smelled a strong odor of marijuana emanating from the vehicle. After first saying that he had no marijuana on him, Foeller eventually told patrol, "I'll make it easy. There's a bowl pack and a little bit of weed in the center console." Patrol located a glass pipe with partially burnt marijuana, a clear plastic bag containing marijuana, a red and white small plastic container with marijuana and a scale with marijuana with marijuana residue. Patrol observed a purple Crown Royal bag on the rear passenger floor board. Patrol asked Foeller what was in the purple bag, to which Foeller replied "I don't know." Patrol opened the purple bag and located a clear plastic container containing marijuana.

Patrol issued Foeller an appearance ticket for unlawful possession of marijuana and a traffic summons for speeding in school zone. Foeller is due to appear in the Town of Royalton Court on Nov. 18.

Patrol secured the evidence at NCSO property for laboratory examination.
