TOWN OF LOCKPORT — A man from Luckey, Ohio must have left his luck at home as he found himself charged with DWI while returning to his hotel from a local bar early this morning courtesy of the Niagara County Sheriff's Office.
Justin P. Happeny, 26, 420 Oak St., Luckey, Ohio, was found asleep at the wheel around 1:06 a.m. on South Transit Road near the Rapids Road intersection, according to the Niagara County Sheriff's Office. When patrol arrived, Twin City ambulance was on scene and advised patrol that they woke Happeny up.
He was determined to be intoxicated but refused to submit to a chemical test of his breath. He was charged with DWI, refusal to take a breath test and failure to obey a traffic signal. He was transported to Niagara County Jail and held under $250 bail and is scheduled to appear in the Town of Lockport Court on Thursday.
