OLCOTT — A Lockport Street man was charged with disorderly conduct Sunday evening after Niagara County Sheriff's deputies say he refused to put out a fire in his backyard.
According to the NCSO report, Adam P. Bootes, 27, 1663 Lockport St., became agitated and swore at deputies who had asked him to extinguish the fire around 4:45 p.m.
According to the report, Bootes said, "No if you (expletive) want it out, use the fire extinguisher from your car," then began walking to the front of his residence and sat on the step of the porch. Patrol again asked him to extinguish the fire, but he refused to do so.
Patrol advised Bootes he was going to be cited for having the open burn again, and he became even more agitated, yelling profane language, which alarmed the patrons of Bye's Popcorn next door.
Bootes was taken to the Niagara County Jail, where he was held in lieu of $150 bail for the disorderly conduct charge. He is to appear in the Town of Newfane Court on Tuesday to be arraigned on the charge. While in jail, he was issued several appearance tickets in relation to the open burn itself.
