TOWN OF LOCKPORT — The New York State Police in conjunction with the New York State Parks Police and the Niagara County Sheriff's Department conducted a sobriety checkpoint on Route 93 in the Town of Lockport on Thursday night into this morning. As a result of the checkpoint, one person was arrested for felony driving while intoxicated.
Michael J. Smith, 43 of Lockport was arrested and charged with felony DWI as well as for having an open container of alcohol in his vehicle. Smith had a previous conviction for DWI within the preceding 10 years, increasing the DWI charge from a misdemeanor to a felony. Smith's BAC was .13 percent. He was issued tickets for the charges and released. He is to answer the charges in the Town of Lockport Court on July 10.
No other arrests were made as a result of the checkpoint. Over 160 vehicles came through the checkpoint during its hours of operation.
