BURT — A Fuller Road man was charged with DWI Sunday evening after an observant citizen flagged down a Niagara County Sheriff's deputy to report a reckless driver.
John F. Hensberry, 53, 2099 Fuller Road, was "swerving all over the road" while driving eastbound on Wilson-Burt Road, the complainant told patrol.
When patrol caught up with Hensberry, he was seen failing to completely stop at a stop sign and also swerving onto the shoulder of the roadway on Drake Settlement Road.
While being interviewed, patrol observed an open can of Busch beer on the floor in the back seat of the truck. Hensberry failed field sobriety tests and tested positive on the roadside alco-sensor, the report said. After being transported to the Niagara County Sheriff's Office, he was found to have a blood-alcohol content of .14 percent.
He was charged with DWI, drinking alcohol in a motor vehicle, driving on the shoulder, and failure to stop at a stop sign. He was held in the Niagara County Jail on $250 bail and ordered to appear in Town of Newfane Court on Tuesday. Jim's Towing removed the vehicle from the scene, and were advised of a 12-hour hold.
