Christopher McOmer
A 39-year-old Gasport man was charged Thursday night with driving while intoxicated with a child in the car — a Leandra's Law violation.

According to a report released by the New York State Police, Christopher J. McOmer was involved in a property damage accident involving  parked car on Dale Road in the Town of Royalton.

Investigation showed that McOmer was traveling westbound on Dale Road when he struck a vehicle with the front end of his red 1998 Mercury Mountaineer. While the Troopers were interviewing McOmer, they detected an odor of an alcoholic beverage on his breath.

After failing field sobriety tests, he was arrested and transported to the Lockport Troopers barracks for processing where he refused a breath test. He was charged with felony DWI, due to a previous conviction of DWI within a 10-year period and aggravated DWI with a child in the vehicle less than 16 years old.

McOmer was arraigned in the Town of Royalton where he was remanded to Niagara County Jail.
