The Niagara County Sheriff's Office arrested 35-year-old Nicholas J. Buscarino of Chestnut Ridge Road around 3 a.m. and charged him with DWI following an accident on Cottage Road.
According to the Sheriff's report, Buscarino was determined to have been southbound on Cottage Road when he lost control of his vehicle due to excessive speed. He crossed the roadway, struck a power pole and then a tree, the report said.
Injured in the accident, Buscarino was transported by Tri-Town Ambulance to Erie County Medical Center. At ECMC, Buscarino told NCSO that he had "too many beers" and was "speeding around" but did not consent to a blood test.
He was charged with DWI, Speed Not Reasonable and Prudent, and Failure to Keep Right. He is scheduled to appear in Royalton Town Court on Dec. 17.
